FLEXMODE PRIVACY POLICY
Effective Date: May 18, 2026
This Privacy Policy (“Policy”) describes how we collect, use, and share your personal information, and how you can exercise your privacy rights and choices.
This Policy applies to the Flexmode platform, including our websites, mobile applications, products, technology, software, and services (collectively, the “Services”). Please also read our Terms of Service (“Terms”), which govern your use of the Services.
In this Policy, “Flexmode,” “we,” “us,” or “our” means Flexmode Florida, LLC, the entity providing the Services to you. Flexmode acts as a “data controller” or “business” for the personal information we process—meaning we decide how and why your information is processed.
If you live in certain U.S. states, additional information about your rights appears in the Notice for Individuals Residing in Certain U.S. States section below.
1. Information We Collect
We collect information about you in three main ways: information you provide, information we collect when you use the Services, and information from other sources.
1.1 Information You Provide
Account Information. When you create an account, we collect information such as your name, email address, phone number, date of birth, city or region, and password.
Profile Information. You may choose to provide additional profile details, such as a profile photo, preferred sport types, skill or experience level, interests, a short bio, social media handles, and favorite venues.
Payment Information. If you purchase a membership, pay Event fees, or make other purchases through the Services, we collect information about the transaction (e.g., amount, date, type of product or Event) and the last four digits of your payment card number. We do not collect or store full payment card numbers; those are handled by PCI-compliant payment processors.
Event Registration Information. When you register for an Event or experience, we may collect additional information, such as emergency contact details, t-shirt size, preferences (e.g., dietary restrictions), and, if you choose to provide it, relevant health or medical information to help manage safety at the Event.
Contacts' Information. You can choose to share contacts from your device or social media accounts to help you find friends or invite others to Flexmode Events. If you share this information, we will access and store it to help you connect with people you may know. You can stop sharing contacts at any time in your device or app settings.
Support and Communications. When you contact us for support, provide feedback, or otherwise communicate with us, we collect the content of your communications and any additional information you choose to provide.
1.2 Information We Collect When You Use the Services
Content You Share. We collect content you share on the Services, such as posts, comments, reviews, Event photos or videos, messages, and other material you upload or create.
Event and Activity Information. We collect information about how you participate in the Flexmode community, including: Events you view, register for, or attend; clubs or groups you join; check-ins; and any performance or participation metrics captured by Event organizers (for example, completion times or rankings at a race-style Event).
Location Information. We may collect or infer location information in two ways:
- From your device, when you allow the app or browser to access precise location (for example, to show Events near you or to enable location-based check-ins).
- From information you provide or that is associated with Events and venues (for example, city, neighborhood, or venue location).
You can disable precise location sharing in your device settings, but some features (like seeing Events near you or location-based suggestions) may not work as intended.
Usage Information. We collect information about how you use the Services, such as when you log in, pages or screens you view, features you use, how you interact with content or other users (e.g., likes, saves, follows), and your settings and preferences.
Device and Technical Information. We collect technical information about the device and network you use to access the Services, including IP address, device identifiers, operating system, browser type, language, mobile network information, crash logs, and performance data.
Cookies and Similar Technologies. We use cookies, pixels, SDKs, local storage, and similar technologies to operate, secure, and improve the Services; remember your preferences; and help show relevant content and ads. For more details, see the Cookies and Similar Tracking Technologies section.
1.3 Information From Other Sources
Connected Apps and Devices. You may choose to connect third-party apps or devices (for example, a fitness tracker or calendar service) to your Flexmode account. Where you do this, we may receive information from those services consistent with their terms and your settings (e.g., basic workout metadata, schedule availability, or similar).
Third-Party Accounts. You can sign up or log in using accounts with other companies, such as Google or Apple (“Third-Party Accounts”). When you do, we receive information from that Third-Party Account, such as your name, email address, and profile picture, as permitted by the provider's privacy settings. To control what information is shared, adjust your settings with the Third-Party Account provider.
Service Providers. We may receive information about you from service providers who help us operate the Services, such as analytics providers, payment processors, marketing providers, and survey tools.
Event Partners and Venues. For certain Events, we may receive information from Event partners or venues (for example, confirmation of your attendance, incident reports, or basic participation details) to help us operate, improve, and keep Events safe.
Other Users. We may receive information about you from other users, such as when they tag you in photos, mention you in posts, invite you to Events, or share your contact information for invitations.
2. How We Use Your Information
We use your information for the following purposes:
2.1 To Provide and Maintain the Services
- Create and manage your account, including authentication and account security.
- Operate core features, such as showing Events, registering you for Events, managing waitlists, tracking attendance, and enabling communication between participants and organizers.
- Process payments and memberships, including billing, refunds (where applicable), and fraud prevention.
- Provide customer support and respond to your questions, requests, and feedback.
2.2 To Personalize and Improve Your Experience
- Personalization. Suggest Events, clubs, locations, and members you may be interested in based on your profile, location, and past activity.
- Recommendations. Highlight Event series, partners, or content relevant to your interests and region.
- Analytics and improvement. Analyze how users interact with the Services to understand what works and where we can improve, develop new features, and enhance the usability and performance of the Services.
2.3 To Enable Community and Social Features
- Help you discover and connect with other users, including those you may know or who share similar interests.
- Facilitate clubs, groups, and community discussions, including group messaging, Event threads, and comments.
- Display your public content (like posts and public Event attendance) in feeds, on Event pages, and in search results, according to your privacy settings.
2.4 To Communicate With You
- Send you service-related communications, such as confirmations, Event updates or cancellations, changes to our Terms or this Policy, and safety or security notices.
- Send marketing communications about Events, memberships, promotions, and features, consistent with your communication preferences and applicable law. You can opt out of marketing communications at any time (see Your Rights and Choices).
2.5 To Support Safety, Security, and Legal Compliance
- Detect, prevent, and respond to fraud, abuse, security incidents, and other harmful or illegal activity.
- Enforce our Terms of Service, Acceptable Use Policy, and Community Standards.
- Investigate and respond to incidents at Events, complaints, or potential violations of our policies.
- Comply with legal obligations, respond to lawful requests (like subpoenas or court orders), and protect our rights, property, and users.
2.6 AI and Automated Tools
We may use limited machine learning and automated tools to support personalization (for example, recommending Events) and to help detect spam or abusive behavior. We do not use automated decision-making that produces legal or similarly significant effects without human review.
2.7 Advertising and Measurement
- Measure ad performance. Understand how people find and use Flexmode, including which ad campaigns drive sign-ups, subscriptions, and Event purchases.
- Optimize ad delivery. Help advertising partners (such as Meta) show our ads to people who are more likely to be interested in Flexmode.
- Build audiences. Create custom or lookalike audiences for advertising based on activity in the Services.
We share limited information with advertising partners for these purposes, subject to your device's tracking permissions. See Section 3.7 Advertising and Measurement Partners for details and your choices.
3. How We Share Your Information
We share information as described below, and only as necessary for the purposes in this Policy.
3.1 Information Visible to Others
Depending on your settings and the features you use, certain information may be visible to other users or the public, including:
- Your public profile (name, photo, city, interests, and bio).
- Events you create, host, or publicly attend.
- Content you post publicly, such as Event photos, comments, or reviews.
- Clubs and groups you join, and your membership in them, where those groups are public.
You can adjust your privacy controls to change what is visible to whom, but some basic information may need to remain visible to operate core features (for example, your name on an Event attendee list).
3.2 Service Providers
We share information with trusted service providers that help us operate, improve, and secure the Services, including:
- Payment processors (e.g., Stripe, Apple, Google)
- Hosting and cloud services (e.g., Amazon Web Services)
- Analytics providers (e.g., Sentry, Meta Platforms)
- Advertising partners (e.g., Meta Platforms / Facebook for ad performance measurement and audience building)
- Email, SMS, and push notification providers
- Customer support tools
- Event-related vendors (e.g., ticketing, registration, or venue management systems)
These providers only receive the information necessary to perform services on our behalf and are contractually required to protect your information and use it only as instructed by Flexmode.
3.3 Event Partners, Sponsors, and Venues
If you register for or attend an Event, we may share relevant information with:
- Event organizers and co-hosts, to manage registration, attendance, logistics, and communications.
- Venues, where necessary for access, safety, or capacity management.
- Sponsors or partners, where you have agreed to such sharing (for example, when an Event page clearly indicates that your registration details will be shared with a sponsor).
Where possible, we share only what is necessary (e.g., your name and Event participation status).
3.4 Third-Party Integrations and Sharing Tools
You may choose to share your activities or Event participation to third-party platforms (such as social media) or connect your Flexmode account to third-party services. When you do this, we share information with those third parties at your direction. Their use of your information is governed by their own policies and not by this Policy.
3.5 Corporate Affiliates and Business Transfers
We may share your information with our corporate affiliates (entities under common ownership or control) in support of providing the Services. If Flexmode is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, your information may be transferred as part of that transaction.
3.6 Legal, Safety, and Protection
We may preserve and share your information with law enforcement, government agencies, or other third parties if we believe in good faith that it is reasonably necessary to:
- Comply with applicable law, legal process, or governmental request.
- Prevent death or serious bodily harm.
- Prevent or investigate fraud, abuse, or illegal activity.
- Protect the rights, property, or safety of Flexmode, our users, or the public.
3.7 Advertising and Measurement Partners
To promote Flexmode and measure how our marketing performs, we work with advertising partners, including Meta Platforms, Inc. (which operates Facebook and Instagram). Through Meta's App Events SDK and similar tools integrated into our mobile app and website, we share the following categories of information with Meta:
- Mobile advertising identifiers (such as Apple's IDFA or Google Advertising ID), where you have given the required permission on your device.
- App event data, such as when you install the app, complete registration, view content, start a trial, subscribe to a paid plan, or complete a purchase. Event data may include the amount and currency of a transaction, the type of subscription or item, and a content identifier.
- Device and technical information, such as device model, operating system version, and app version.
We use this information to:
- Measure the effectiveness of our ads on Meta's platforms.
- Help Meta optimize ad delivery to people likely to be interested in Flexmode.
- Build custom and lookalike audiences for advertising.
Meta processes this information under its own privacy policy and acts as a controller or business with respect to its own use of the data for ad optimization and audience building across its platforms. You can learn more in Meta's Privacy Policy.
Your choices. You can control or limit this data sharing in the following ways:
- iOS: When prompted by Flexmode, you can choose “Ask App Not to Track,” which prevents us from sharing your IDFA with Meta and limits ad measurement. You can change this at any time in your device's Settings → Privacy & Security → Tracking.
- Android: You can reset or delete your Advertising ID and opt out of personalized ads in your device's Settings → Google → Ads.
- Meta account settings: If you have a Facebook or Instagram account, you can adjust your ad preferences directly in those services to limit how Meta uses information it receives from us.
4. Cookies, SDKs, and Similar Tracking Technologies
We use cookies, pixels, mobile software development kits (SDKs), and similar technologies to:
- Authenticate you and keep you logged in.
- Remember your preferences and settings.
- Analyze usage and diagnose errors to improve the Services.
- Provide and measure the effectiveness of marketing and advertising, including targeted ads.
Specific tools we use in our mobile app and website include:
- Meta App Events SDK (Facebook / Instagram) — for measuring app installs and in-app actions tied to our advertising, optimizing ad delivery, and building audiences. See Section 3.7 Advertising and Measurement Partners for details and your choices.
- Sentry — for crash reporting and error diagnostics.
- Expo / Apple / Google push notification services — for delivering in-app notifications you have enabled.
- First-party authentication and session technologies — to keep you signed in and to secure your account.
You can manage these technologies in several ways:
- Browser: through your browser's cookie and tracking settings.
- iOS: through the App Tracking Transparency prompt (Settings → Privacy & Security → Tracking).
- Android: through your device's Advertising ID controls (Settings → Google → Ads).
- In-app: through your notification, location, and account settings inside Flexmode.
If you disable these technologies, some features of the Services may not function properly, and our ads may become less relevant to you.
5. Your Rights and Choices
Depending on where you live and subject to applicable law, you may have the following rights:
5.1 Access and Portability
You may have the right to request access to the personal information we hold about you, including a copy of your data in a structured, commonly used, and machine-readable format. Much of this information is available directly in your account settings.
5.2 Correction
You may have the right to correct inaccurate or incomplete personal information. You can update most Account and Profile Information directly in your account.
5.3 Deletion
You may have the right to request deletion of your personal information. You can delete certain content (such as posts or photos) yourself, and you can request deletion of your account in your settings. Once your account is deleted, we generally cannot restore your data, and some information may continue to exist in backups for a limited period or where we are required to retain it by law.
5.4 Restriction and Objection
In some regions, you may have the right to request that we restrict certain processing of your information, or to object to processing based on our legitimate interests (for example, certain types of profiling or direct marketing).
5.5 Marketing Choices
You can manage your marketing preferences by:
- Using the “unsubscribe” link in marketing emails.
- Adjusting notification settings in your account.
Even if you opt out of marketing emails, we may still send you transactional or service-related messages (for example, about Event registrations or changes to this Policy).
To exercise your rights, you can contact us using the details in the Contact Us section. We may need to verify your identity before fulfilling your request.
6. Children's Privacy
Our Services are not intended for or directed to children under 18 years of age, and we do not knowingly collect personal information from individuals under 18. If we become aware that we have collected personal information from someone under 18, we will take steps to delete that information.
If you believe we have collected data from a minor, please contact us using the information in the Contact Us section.
7. How We Protect Your Information
We take reasonable and appropriate administrative, technical, and physical measures designed to protect your personal information from unauthorized access, use, disclosure, alteration, and destruction.
These measures include access controls, encryption where appropriate, network security tools, and regular review of our security practices. However, no system is completely secure, and we cannot guarantee absolute security of your information.
8. Data Retention
We retain your personal information for as long as necessary to:
- Provide the Services and support your use of them.
- Comply with legal, tax, accounting, and regulatory obligations.
- Resolve disputes and enforce our agreements.
When we no longer need personal information for these purposes, we will delete or anonymize it, or if that is not possible (for example, in backup archives), we will securely store it and isolate it from further use until deletion is possible.
9. International Data Transfers
If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and other countries where we or our service providers operate. These countries may have data protection laws that are different from those in your country.
Where required by law, we use appropriate safeguards (such as Standard Contractual Clauses) to protect personal information transferred internationally. You may contact us for more information about these safeguards.
10. Notice for Individuals Residing in the EEA, UK, Switzerland, Brazil, and Other Regions
If you are residing in the EEA, UK, Switzerland, Brazil, or a jurisdiction with similar laws, the following additional information applies:
Legal Bases. We process your personal information on one or more of the following legal bases: contract (to provide the Services); consent (where you have given it, such as for certain marketing or location data); legitimate interests (for example, to secure and improve the Services, and to personalize content in ways that do not override your rights); legal obligations; and vital interests (for safety-related processing).
You may have additional rights to object to processing based on legitimate interests, to request restriction of processing, and to lodge a complaint with your local data protection authority.
11. Notice for Individuals Residing in Certain U.S. States
Residents of states with comprehensive privacy laws (such as California, Colorado, Connecticut, Utah, Virginia, and others as adopted) may have additional rights, including:
- Right to know what categories of personal information we collect and disclose.
- Right to access, correct, or delete personal information.
- Right to opt out of certain types of “sharing” or targeted advertising.
- Right not to be discriminated against for exercising these rights.
We describe the categories of information we collect and disclose in the Information We Collect and How We Share Your Information sections above.
You can exercise applicable state privacy rights by contacting us as described in Contact Us. Where relevant, you can also use in-app settings or a “Do Not Share My Personal Information” link (if provided) to manage targeted advertising preferences.
We do not sell your personal information for money. We may engage in limited “sharing” for targeted advertising, which you can opt out of where required by law.
12. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices, the Services, or applicable law. When we do, we will:
- Post the updated Policy and a new “Effective Date” at the top.
- Provide additional notice (such as by email or in-app notification) if we make changes we believe are material.
If you do not agree with the updated Policy, you should stop using the Services and may request deletion of your account. Your continued use of the Services after the effective date of any changes means you accept the updated Policy.
